Terms and Conditions
1. Application
All inquiries, quotes, estimates, bookings, and any services provided by Pachamama Experiences CR are subject to these terms and conditions.
2. The Client and Authority
The individual who requests a quote, information, or makes a reservation, or receives any type of service, is considered to have read, understood, and accepted these terms and conditions, either directly or through explanation.
3. Services
3.1 Pachamama Experiences CR offers its clients tours, transportation (upon prior arrangement), lodging, educational experiences, and adventure activities in Costa Rica's stunning natural settings.
3.2 Pachamama Experiences CR accepts no responsibility for any loss, damage, injury, illness, or death suffered by any client resulting from actions or omissions that contradict instructions or obligations.
4. Reservations
4.1 You must be at least 18 years old to make a reservation. You agree to provide complete and accurate information at the time of booking.
4.2 All reservations must be processed in advance of the client’s arrival and are subject to availability at the time of request. Reservations are not guaranteed until a 50% deposit of the total cost is received.
4.3 To reserve a tour, a 50% deposit must be made. The total balance must be paid according to the agreed dates and no later than 24 hours before the start of the service.
4.4 Multi-day packages may include lodging, depending on group size and availability. In the event of a change in hotel availability, the replacement lodging will be of similar category and communicated in advance at no additional cost.
4.5 Reservation requests will be answered within 2 business days of receipt. Once processed, a confirmation of receipt will be sent.
5. Pricing
5.1 Once a reservation is confirmed, its price will not change due to future promotions. Price adjustments during planning will only occur with client consent.
5.2 If the price adjustment exceeds 10% of the total cost, the client will be notified and may cancel the contract without penalty.
5.3 Discounts may be offered up to 15 days before a tour. As a result, different participants may pay different prices for the same experience.
5.4 Prices are per person and include only the services specified in the tour description.
5.5 Prices are listed in USD and CRC and must be paid in either of these two currencies.
5.6 Prices do not include extra costs such as phone calls, national park entrance fees, laundry, minibar, personal tips, transportation (unless stated), or any unspecified services.
6. Payments and Methods
6.1 Total payment and installment payments must be made by the deadlines established by the company. Failure to do so may result in contract cancellation.
6.2 Payments can be made by credit card (note: additional fees may apply depending on your card or bank) or via bank transfer (transfer fees are the client's responsibility). For bank details, email us at admin@pachamamaexperiencescr.com.
6.3 If a change is required due to the client’s unavailability, any resulting fees from providers will be passed on to the client.
7. Health and Medical Information
7.1 It is your responsibility to be physically and mentally fit to participate in the activities offered.
7.2 You must inform the company of any illnesses, allergies, medications, or relevant medical information that could affect your participation.
7.3 The company is not responsible for any health issues not disclosed prior to the activity.
7.4 You are responsible for assessing the physical demands of the activity based on your own health conditions.
7.5 If you have any health condition, physical limitations, or specific dietary requirements, you must inform us during booking. Additional charges may apply for changes requested by the client.
7.6 Pachamama Experiences CR carries a basic first aid kit for injuries, but it does not include medication. Any needed medication must be brought by the client.
7.7 Pregnancy is considered a medical condition and must be disclosed during booking. Pachamama Experiences CR reserves the right to deny participation to pregnant clients.
7.8 Pachamama Experiences CR reserves the right to deny participation in any activity if it determines that a person's physical or mental condition is unsuitable.
7.9 We will do our best to accommodate dietary restrictions, but cannot guarantee full compliance.
8. Risk Acceptance
8.1 By booking, you acknowledge that adventure activities offered by Pachamama Experiences CR involve inherent risks to health and safety. You voluntarily assume all such risks and release Pachamama Experiences CR from liability.
8.2 Clients are responsible for ensuring they are in good physical condition and aware of the risks involved. Pachamama Experiences CR assumes no responsibility beyond its insurance coverage, and clients are responsible for any additional medical costs.
9. Marketing and Publicity
9.1 Images and videos used in marketing are for illustrative purposes and may not reflect exact conditions due to weather or external factors.
9.2 By participating in our tours, you authorize Pachamama Experiences CR and its partners to use photos or videos taken during your experience for promotional purposes without compensation or further consent.
10. Privacy Policy
Pachamama Experiences CR will not disclose personal client information to third parties. All data is used solely to ensure the services contracted are fulfilled. For questions, contact us — we're happy to help.
11. Cancellation Policy and Additional Conditions
11.1 All cancellations must be sent in writing to admin@pachamamaexperiencescr.com.
11.2 No refunds will be given for voluntarily unused services.
11.3 Same-day cancellations are not eligible for refunds or rescheduling.
11.4 Cancellations due to illness must be supported with a medical certificate if made within 3 days of the tour. If accepted, a credit or partial/full refund may be issued, less any non-refundable provider costs.
11.5 Pachamama Experiences CR is not responsible for cancellations due to force majeure, including but not limited to war, strikes, natural disasters, terrorism, or adverse weather.
11.6 We do not guarantee wildlife sightings or specific weather conditions, and these are not grounds for complaints or refunds.
11.7 Clients are fully responsible for their luggage. While we will support claims with the authorities, we are not liable for lost items.
11.8 Any health issues or dietary needs must be communicated during booking. Additional fees may apply for changes.
11.9 If minimum participant requirements are not met, Pachamama Experiences CR may cancel or reschedule the tour. If the client declines the new option, 50% of the paid amount will be refunded.
12. Early Cancellation Penalties
12.1 No penalty applies for cancellations made more than 7 days before the tour date.
12.2 Penalties for later cancellations:

50% refund for cancellations made 3 days before

No refund for cancellations within 48 hours

No refund for cancellations due to weather or if a participant’s limitations compromise the safety of the group
12.3 For prepaid services canceled by the client, the refund depends on the hotel or provider’s policy. Please consider this to avoid issues.
